Manslaughter Charges Filed Against Lynnway Auto Auction and Company President in Connection with Fatal Crash

Billerica Police | MA Posted on March 28, 2019 by BPD TechMarch 28, 2019

BILLERICA – Middlesex District Attorney Marian Ryan and Billerica Chief of Police Daniel Rosa have confirmed that Lynnway Auto Auction, Inc. and Company President James Lamb were each indicted today on five counts of manslaughter in connection with the 2017 fatal crash. These indictments allege that the company and Mr. Lamb are criminally responsible for willfully, wantonly, and recklessly failing to take appropriate actions that could have prevented the death of five people.

After an extensive examination of the crash, investigators determined that Lynnway Auto Auction, Inc. and James Lamb who was responsible for day-to day operations, were aware of shortfalls in the safety measures in place at the auction facility and that they failed to ensure that all drivers were properly licensed and trained.

As part of the investigation into this incident prosecutors also reviewed reports by the Occupational Safety and Health Administration (OSHA) as well as incident reports generated by Lynnway Auto Auction which described previous instances in which Lynnway employees were struck by vehicles or otherwise injured in unsafe conditions. Lynnway had previously been notified that they should not employ unlicensed drivers. Despite these recommendations, Lynnway and Mr. Lamb did not ensure that operators had driver’s licenses, and the employer did not train or ensure the employees knew how to operate the vehicles.

On May 3, 2017, at approximately 10:11 a.m., a 2006 Jeep Grand Cherokee being operated by an unlicensed driver employed by Lynnway Auto Auction, Inc. entered the auction showroom at a high rate of speed and drove into the designated pedestrian area striking several people, and crashed through the cinder block wall. Two victims, Pantaleon Santos and Leezandra Aponte, were pronounced dead on scene. Brenda Lopez was transported to an area hospital where she later died from her injuries. Nine others were transported to area hospitals. Two additional victims, Elliott Rowlands, Jr. and Ruben Espaillat later died of their injuries.

Based on a review of video surveillance of the crash, investigators determined that the Jeep pulled up to the garage door and within seconds rapidly accelerated leaving the red vehicle travel lane crossing into the blue pedestrian lane. The vehicle continued until it crashed through a cinder block wall. It crossed the entire length of the building in under four seconds. Based on the reconstruction of the crash it is estimated that the vehicle was travelling at approximately 32 MPH inside the building at the time of the crash.

The investigation also revealed that despite an incident in 2014 in which a worker was seriously injured, the defendants failed to implement safety measures, including, but not limited to, installing barriers to cordon off the auction lanes and protect the pedestrians mingling and maneuvering between and around moving vehicles. Even though James Lamb signed the certification of corrective action worksheet and abatement letter on behalf of Lynnway in response to the 2014 incident, safety measures were not fully implemented.

After a review of all the facts and circumstances of the case, it has been determined that the driver of the vehicle will not face criminal charges. Although the operator of the Jeep was driving with an expired driver’s license, under Massachusetts Law, an individual is allowed to operate a motor vehicle on private property without a license. The Lynnway facility is not a public way; therefore the Commonwealth has determined that it would not be able to meet its burden of proof beyond a reasonable doubt that the driver of the vehicle acted recklessly, and therefore he has not been charged with manslaughter.

In total today the Middlesex Grand Jury returned direct indictments of five counts of manslaughter against James Lamb and five counts of manslaughter against Lynnway Auto Auction, Inc. representing one count for each victim.

This crash was investigated by the Middlesex District Attorney’s Office, the Billerica Police Department, the Massachusetts State Police Collision Analysis and Reconstruction Section and the Occupational Safety and Health Administration.

These charges are allegations and the defendants are presumed innocent until proven guilty. An arraignment date for Mr. Lamb has not yet been scheduled.

Billerica Home Health Aid Arrested for Stealing Elderly Patient’s Credit Card

Billerica Police | MA Posted on March 12, 2019 by BPD TechMarch 12, 2019

BPD PatchBillerica – On Monday, March 11, 2019, Billerica Police arrested Christine Wojcik, 47, of Billerica following a four week investigation into the theft of a local elderly couple’s credit card. Billerica Police allege that Ms. Wojcik had been hired by the victims’ family to provide home health care assistance to the couple. After the passing of one of the elders, a family member discovered dozens of charges had been made on a credit card belonging to the couple, which was only kept for emergency needs. After discovering over forty new charges totaling over $5,000 on the previously zero balance card, the police were contacted. Police detectives were able to secure digital evidence showing the involved card being used by Ms. Wojcik throughout the Greater Lowell area, including a late January 2019 trip to Foxwoods Casino in Connecticut. Ms. Wojcik will be arraigned in Lowell District Court on Tuesday, March 12, 2019 on charges of Larceny Over $1,200 through a Single Scheme, Receiving a Stolen Credit Card and Misleading a Police Investigation.

Of note, all of the above charges are considered allegations and Ms. Wojcik is presumed innocent of these charges until proved guilty beyond a reasonable doubt in a court of law.

Any additional questions should be directed to Deputy Chief Roy Frost, 978-215-9653.

Text to 911 Is Available in the Commonwealth

Billerica Police | MA Posted on February 1, 2019 by BPD TechFebruary 1, 2019

On December 14, 2018, Text-to-911 was deployed across the Commonwealth. This is one of the most exciting changes for accessibility to emergency services in more than 20 years. When a citizen sends a text message to 911, it will be routed to an emergency call center based on the location information provided by the carrier. For this reason, when a citizen sends a Text-to-911, they should make every effort to text the town name, address or location that they are located in.

What is Text-to-911?

Text-to-911 is the ability to send a text message to reach 911 emergency call takers from your mobile device.

How Do I Reach Text-to-911?

When using a texting app on a device, type the numbers “911” into the “To” or “Recipient” field.

What Information Should I Give Text-to-911?

You should make every effort to text the following:
• what is happening (nature of the incident);
• location including the address/location and town name;
• any additional details about the location you can provide such as landmarks, cross streets, nearby business names, apartment number, floor, room or suite numbers, or any details that may be helpful in locating you.

When Should I Use Text-to-911?

Texting should only be used during an emergency when you are unable to make a voice call to 911. Making a voice call is the most efficient way to get access to emergency services. Text-to-911 will be useful for citizens who are deaf, hard of hearing, or speech impaired. Text-to-911 eliminates the need to use ancillary Teletypewriter (TTY) equipment, or third party services to access 911.

What Happens Next?

The 911 professional in the emergency call center will ask you many questions, will assist in sending first responders to the location you identify, and may provide instructions on things for you to do.

Why Didn’t My Text Go Through?

Messages sent to Text-to-911 may not be received. If you attempt to send a Text-to-911 where the service is not available, wireless carriers provide an automatic “bounce-back” message. Bounce-back messages are intended to minimize the risk that you mistakenly believe that your text was sent and received by an emergency call center. As part of the bounce-back message, you will be advised to contact emergency services by another means. Text-to-911 is currently available throughout the Commonwealth. However, across the country, Text-to-911 may only be in certain locations. Whenever possible, you should always make a voice call to 911 during an emergency.

Are There Any Text-to-911 Limitations I Should Know About?

Text-to-911 uses native texting technology called Short Message Service (SMS). Therefore, you must have a text or data plan on your mobile device to Text-to-911 and you should avoid sending:

• multi-media such as pictures, videos and emoticons;
• a message to more than one person as a recipient;
• messages exceeding the 160 character limit, as the messages will be broken and may be delivered out of order.

Text-to-911 rules do not apply to the following: third party texting applications (apps) on mobile devices that do not support texting to and from U.S. phone numbers, apps that only support texting with other app users, or texting through social media. This can include message services over WiFi networks, where a text or data plan is not required.
